Swimming pool accidents and drowning deaths occur all too frequently, with children often the victims of these unfortunate accidents. According to the Centers for Disease Control and Prevention, more than one-fifth of fatal drowning victims are children 14 years of age or younger and for every child who dies from drowning, another four children received emergency department medical care for nonfatal injuries. Even those swimming pool accidents that do not result in death can result in long-term disabilities such as memory loss, learning disabilities and a permanent vegetative state, according to the CDC.
Unfortunately, many swimming pool accidents are preventable with the accident occurring due to the negligence of the swimming pool owner or operator. Swimming pool owners, including homeowners, hotels, resorts, schools, water parks and city public pool operators, are obligated to provide a safe swimming pool area by taking certain precautions to prevent swimming pool accidents from occurring.
Some common causes of swimming pool accidents include:
- Inadequate warning signs
- Inadequate lifeguard staff
- Defective or inadequate safety equipment
- Ineffective barriers around the swimming pool
- Defective pool drains
- Contaminated water
- Overcrowding
If you or a loved one has been involved in a swimming pool accident, you may be able entitled to compensation from the swimming pool owner or operator through a premises liability or wrongful death lawsuit. Premises liability creates a legal obligation on property owners, including owners and operators of swimming pools, to provide safe conditions for those entering the property. The failure to do so can make them liable for any injuries sustained on their property.
